Brazil court suspends Stake’s temporary operating right

Stake has lost its temporary right to keep operating in Brazil. A federal regional court suspended a decision that had allowed it to continue until 25 October 2026 despite the country's gambling ban.

What happened

President Luiz Inácio Lula da Silva's decree banning all forms of gambling took effect on 25 September 2026. Judge Rodrigues dos Santos of São Paulo's 9th Federal Civil Court then allowed Stake to keep trading until 25 October – the only licensed operator granted that right, which some described as a de facto monopoly.

The ruling did not last. Judge Di Salvo of the higher Federal Regional Court suspended it, citing the risk of "regulatory asymmetry". According to SBC News, the appeal was most likely filed by the Attorney General's Office (AGU) or the Federal Prosecutor's Office (PGR), both of which back the decree.

Key points
  • Brazil's gambling ban has applied since 25 September 2026.
  • Stake's right to operate until 25 October was suspended on appeal.
  • Licensed operators entered the market in 2024, many with five-year SPA licences.
  • Congress and the Supreme Court will decide the ban's future.

What comes next

Industry groups ANJL and IBJR, which represent most licensed operators, argue the ban undermines the multi-year licensing system. Congress and the Supreme Court may take up the issue after the presidential election cycle ends on 25 October 2026.
